Approximately seven in every 1000 infants are born with a birth injury. While some birth injuries are caused by a mother's pre-existing condition, many are unfortunately caused when a doctor or nurse fails to meet the appropriate standard of care before, during or after the delivery. Some common birth injuries include:

Cerebral Palsy: Can be caused by a doctor or nurse's failure to monitor the infant's heart and oxygen flow to the brain. Insufficient oxygen to the brain can cause irreversible brain damage.

Erb's Palsy: Occurs when the fetus is too big for the mother's vaginal canal and must be maneuvered around the pubic bone, possibly causing serious nerve damage to the infant's shoulder or neck. If the doctor negligently performs this maneuvering or failed to recommend a caesarian section after discovering a risk for Erb's palsy, medical malpractice can be alleged.

Brachial Plexus: Brachial plexus causes paralysis of the arm, lack of muscle control in the arm and an increased or decreased feeling in the hand or arm. This can occur if the infant's shoulder is stretched during the delivery process.

Uterine Rupture: If the mother previously had a child by C-section and delivers a subsequent child vaginally, there is an increased risk of uterine rupture. This occurs when the scar tissue from the previous caesarian procedure ruptures and the infant's head winds up in the mother's abdominal cavity, depriving it of oxygen.

Birth Trauma: Bleeding in the brain, also known as cephalohematoma, can occur after an improper use of forceps or a vacuum.

  • Failure to anticipate maternal health complications
  • Failure to observe or respond to entrapment of the umbilical cord
  • Inappropriate use of Pitocin, a synthesized hormone used to speed up or induce labor
  • Failure to respond appropriately to bleeding
